Frank Montgomery may be indicted by county DA

The Tarrant County District Attorney’s office will seek an indictment of suspended football player Frank Montgomery when a final autopsy report is available.

Montgomery was in the county jail Tuesday on $250,000 bail in connection with the July 3 death of his girlfriend’s 16-month-old daughter.

Jay Lapham, chief of the Crimes Against Children Unit at the district attorney’s office, said he does not know when to expect the final report. He said the charge may be upgraded from injury to a child to capital murder.

Montgomery was suspended from the university July 23, said Don Mills, vice chancellor for student affairs.

Mills said the university will determine whether to expel Montgomery based upon his compliance with the student code of conduct and not the judicial proceedings.

A head scan at Cook Children’s Medical Center showed that Savannah Koiner, the deceased infant, received a significant blow to the head, according to a Benbrook police report.

Football coach Gary Patterson would not comment on the situation since the investigation is ongoing, his secretary said.
